Personal Injury Attorney, Eva Brindisi Pearlman, Supports Sunshine Law to Keep Scaffolding Law Intact.

Utica, NY, May 26, 2015: Personal Injury Attorney Eva Brindisi Pearlman, partner at the Law Offices of Brindisi, Murad, Brindisi & Pearlman has posted a new article on the law offices website entitled “Don’t Let Our Construction Workers Down. Let the Sunshine In.”

Pearlman wonders, “Why would anyone in their right mind want to do away with a law that protects our brave construction crews in New York State?” She adds, “Men and women risk their lives everyday working on scaffolding at construction jobs. These workers trust that those in charge of he job site will provide proper safety equipment to keep them secure and protected while working at elevated heights. When scaffolding accidents occur very often the injuries are critical and unfortunately, many times death is the end result.”

A steel-like tension exists between opposing factions. Pearlman elaborates, “The long-standing argument against the Scaffold Law is that it raises the cost of business insurance in New York State.” She adds, “However Assemblyman Francisco Moya (D-Queens) and Assemblyman Marcos Crespo (D-Bronx) are challenging those claims by forcing insurance companies to release claims data in proposed legislation known as “The Construction Insurance Transparency Act of 2015” or otherwise referred to as the Sunshine Bill.”

Pearlman turns to an article in the Legislative Gazette in which Assemblyman Moya has said, “What this debate really needs is some hard facts. If the Scaffold Law is actually driving up costs, then let’s take a look at how we can fix that while protecting our workers.” He goes on to say, “Unfortunately, the anti-scaffold law lobby doesn’t want to give us any information, they want to keep us in the dark about how insurance rates are set. And if there is anything to hide, then all we have to say is ‘show us the data.'”

According to Pearlman, “We should insist on transparency from the insurance companies regarding their practices related to construction accident payouts. In the Legislative Gazette article, Assemblyman Crespo said, “if not for this legislation, until we get it done, we don’t even know what playing field they’re playing on.”

Pearlman again quotes Crespo who said, “Forget about an unfair balance. That is an insult to the men and women who make this city run, the men and women who believe in this city, who have made an investment in this city, who raise their children here, they deserve better. Their safety should never be questioned.”

Pearlman agrees stating, “Worker safety should never be compromised and we should be working harder to strengthen worker safety laws not trying to repeal the ones that are already in existence in New York State. The health and wellbeing of New York workers must be the primary consideration and the bottom financial line should never be more important than human life.”

Pearlman encourages readers, “Please urge your legislators to support the
“Sunshine Law” and keep the “Scaffold Law” intact. The lives of construction workers are at stake. The very infrastructure of our State is at stake.”
