Tax Resolution Attorney, Jeffrey T. Jones, Focuses on Dog Bite Law With The Start of Dog Bite Prevention Week May 18th.

Charleston, WV, May 12, 2015: Tax resolution specialist attorney Jeffrey T. Jones, founder of the Law Offices of Jeffrey T. Jones, and best-selling author of “Protect and Defend has posted a new blog on his website, just in time for summer, entitled “Owner Liability When The Dog Bites.” With Dog Bite Prevention Week beginning May 18th, Jones’ article is timely.

The summer weather is irresistible and, as Jones writes, “With the warmer weather drawing people out for long days in the parks and other public areas with their dogs, it’s important to be aware of the West Virginia dog bite laws in the event of a dog bite.” He adds, “Summer time is when the majority of dog bites occur. So, whether you own a dog or not, this is information that could be valuable.”

Even though, as Jones states, “Most owners go to great lengths to train their dogs to respond to their commands. However, it is impossible to predict an animal’s behavior.” Whenever a dog bite occurs, usually no one is more surprised than the owner. As Jones says, “Even the most well behaved dogs have been known to unexpectedly bite human beings and other dogs.”

According to Jones, West Virginia “imposes strict liability on dog owners or keepers when a dog causes injury while the dog is allowed to run at large.” He elaborates, ”What the term “strict liability” means in this case is that the injured person does not have to prove that the owner or keeper knew the dog would act aggressively.” On the other hand, he says, “If a dog bites someone on the owner’s property, or if someone other than the owner or keeper allowed the dog to run freely, the strict liability dog bite law does not apply.”

Jones provides online resources for safety information. He states, “If you have little ones, Prevent the Bite provides posters and safety information to teach children how to correctly approach a dog.” Jones adds, “ Remember, a responsible dog owner should: 1) Never leave a baby or small child alone with a dog, even if it is a family pet. Often, dogs bite children in their own homes. 2) Ask permission before touching or playing with a dog. And 3) remember that any dog can be dangerous and any dog can bite.

In conclusion Jones warns, “A beautiful day can very quickly deteriorate into a dangerous potentially life-threatening situation if a dog turns from playful into aggressive. Know your rights, as an owner and as a potential victim.”
