Pearlman reports that, “Under current NYS law, the statute of limitations for medical malpractice claims is 2 ½ years from the date of the negligent act or failure to act or date of last treatment where there has been continuous treatment.” She further points out that, “This particular statute is the shortest negligence statute in New York State (other than against municipalities) and often creates unfair hardship for patients harmed as a result of medical malpractice since many times the injury is not discovered until well after the statute of limitations has expired.”

Pearlman says, “The proposed legislation (A285 and S911) recognizes that some injuries do not manifest themselves at the time of the negligent act; and, therefore, permits a victim of medical malpractice to discover his or her injury before their statutory period to begin suit runs.” Pearlman adds, “Under the proposed bills, the patient still has to show that their medical malpractice claim has merit. These bills would simply prevent the statute of limitations from being used to unfairly shield professionally negligent medical misconduct.”
